| Resumen : | En el presente trabajo de investigación denominada “Garantías Jurisdiccionales como mecanismo de protección al derecho a la salud en pacientes oncológicos”, tiene como principal objetivo fundamentar los preceptos legales y doctrinarios que protegen el derecho a la salud en el ordenamiento jurídico ecuatoriano, los mismos que serán analizados mediante un estudio de campo y análisis jurídico para cuantificar la desprotección del derecho a la salud, la falta de acceso de medicamentos según la disponibilidad del Cuadro Nacional de Medicamentos Básicos que soportan las personas con enfermedades catastróficas (oncológicas), surgiendo una terrible problemática social y jurídica sobre el ejercicio efectivo de gozar una salud integral, gratuita y especializado, recurriendo al aparato judicial como mecanismo de protección para garantizar el acceso al mismo. |
| Descripción : | Abstract: In the present research work called “Jurisdictional Guarantees as a mechanism to protect the right to health in cáncer patients”, its main objective is to base the legal and doctrinal precepts that protect the right to health in the Ecuadorian legal system, the same as they will be analyzed through a field study and legal analysis to quantify the lack of protection of the right to health, the lack of Access to medicines according to the availability of the National Table of Basic Medicines that support people with catastrophic (oncological) diseases, and a terrible problema arises social and legal on the effective excercise of enjoying comprehensive, free and specialized health, resorting to the judicial apparatus as a protection mechanism to guarantee Access to it. |
