Los derechos y garantías constitucionales y la vacunación obligatorio contra el COVID-19 en Ecuador

Abstract

Covid 19 is an infectious disease caused by a coronavirus that is transmitted mainly through droplets generated when the infected person coughs, sneezes or exhales. This disease spread in the year 2019-2020, becoming a pandemic that leaves more than 2,000,000 deaths and thousands of infested. The consequences, in addition to the death of millions of people, have left the countries in a serious state of poverty due to the stagnation of productive and commercial activities. This situation has forced countries to seek vaccines that help resolve the pandemic and return to the world the peace and prosperity to which the peoples have rights. The problem is that millions of people, perhaps due to adverse advertising, do not want to be vaccinated. Faced with this situation, this investigation has arisen whose general objective is to determine whether the Ecuadorian State based on the Constitution and the Law can force the population to be vaccinated against Covid-19 with the vaccine selected by the State. The research is of the mixed type because it includes documentary and field work and was structured in three chapters: Chapter I contains a theoretical framework intended to describe fundamental elements that help explain the different topics related to the covid disease, vaccination against it. and the constitutional and legal aspects that indicate whether health being a right, the Ecuadorian State can force the population to get the covid vaccine. Chapter II will describe the methodological arc that guided the research and Chapter III refers to the analysis of the results.
