    This work is aimed at finding the functionality of the restrictive freedom sentence for the type of kidnapping, since this crime has a high rate of commission that affects society. It is addressed in its first chapter, the background of the investigation, theoretical bases, elements and characteristics of the kidnapping, the penalty imposed in this crime, the purpose of the penalty with their respective theories. In its second chapter, the research methodology is explained, which is of a documentary type under a qualitative approach, with information gathering, through critical reading, underlined, while the information analysis was carried out through the method of hermeneutics or legal interpretation. The third chapter presents the analysis and interpretation of results, the proposed solution, clarifying the issue raised, concluding that the issues addressed are related to the issue that is the subject of this study
