dc.description.abstractLa cadena de custodia tiene fundamento legal en el Código Orgánico Integral Penal, el cual indica el tratamiento legal que se debe otorgar a este procedimiento. En el presente ensayo investigativo se estudiarán los antecedentes, concepto, características, así como también las irregularidades que se presentan en torno a la cadena de custodia. La cadena de custodia empieza en el momento de la recolección, y finaliza por orden del personal competente, este es el procedimiento que se encarga de preservar a las pruebas recolectadas en la escena del delito, estas pruebas son materiales físicos que desde el momento en que son recolectadas, deben estar resguardadas por los agentes especializados, encargados de llevar a cabo este proceso, no obstante, es necesario mencionar también que el manejo, envío y análisis de las pruebas forman parte esencial del procedimiento. El principal objetivo de la cadena de custodia, y el cual consta en la norma ecuatoriana es garantizar la autenticidad de la prueba para que le conduzca al juzgador al convencimiento de los hechos. La principal motivación para este ensayo es la investigación de las irregularidades que se presenten en el proceso de la cadena de custodia.es
dc.description.abstractThe chain of custody has a legal basis in the Comprehensive Organic Criminal Code, which indicates the legal treatment that should be given to this procedure. In this investigative essay, the background, concept, characteristics, as well as the irregularities that arise around the completeness of the process will be studied. The chain of custody begins at the time of collection, and ends by order of the competent personnel, this is the procedure that is responsible for preserving the evidence collected at the crime scene, these tests are physical materials that from the moment they are collected, they must be protected by the specialized agents, in charge of carrying out this process, however, it is also necessary to mention that the handling, shipment and analysis of the tests are an essential part of the procedure. The main objective of the chain of custody, and which is included in the Ecuadorian norm, is to guarantee the authenticity of the evidence so that it leads the judge to convince the facts. The main motivation for this essay is the investigation of the irregularities that arise in the process of the chain of custody.en_US
