dc.description.abstractEn el ámbito del Derecho Penal, el error de tipo invencible se refiere a la situación en la cual un individuo comete un acto ilícito sin tener conocimiento real o posibilidad de conocer la naturaleza del hecho delictivo que está cometiendo. Este tipo de error plantea importantes cuestiones jurídicas relacionadas con la culpabilidad, la imputabilidad y la justicia en el proceso penal. A pesar de su relevancia, existe una falta de claridad y uniformidad en la interpretación y aplicación de este concepto en diferentes jurisdicciones, lo que genera incertidumbre y desafíos en el sistema legal, el error de tipo invencible es un concepto fundamental en el Derecho Penal que afecta la determinación de la culpabilidad de un individuo en casos de infracciones penales. Este error puede surgir cuando una persona actúa de buena fe, creyendo erróneamente que su conducta es lícita o que está cumpliendo con ciertos requisitos legales, cuando en realidad está cometiendo un delito. La problemática central radica en la ambigüedad y falta de claridad en la definición y aplicación del error de tipo invencible en el Derecho Penal. Esto puede llevar a resultados injustos en el proceso penal, ya que las personas pueden ser condenadas por actos que cometieron sin conocimiento de su ilegalidad real. Además, la falta de uniformidad en la interpretación y aplicación del error de tipo invencible puede generar confusión en la justicia penal ecuatoriana.es
dc.description.abstractIn the field of criminal law, the invincible type error refers to the situation in which an individual commits an illegal act without having real knowledge or possibility of knowing the nature of the criminal act that is being committed. This type of error raises important legal questions related to guilt, imputability and justice in the criminal process. Despite its relevance, there is a lack of clarity and uniformity in the interpretation and application of this concept in different jurisdictions, which generates uncertainty and challenges in the legal system, the invincible type error is a fundamental concept in criminal law that affects the determination of an individual's guilt in cases of criminal offenses. This error can arise when a person acts in good faith, mistakenly believing that their conduct is lawful or that they are complying with certain legal requirements, when in fact they are committing a crime. The central problem lies in the ambiguity and lack of clarity in the definition and application of the invincible type error in criminal law. This can lead to unfair results in the criminal process, since people can be sentenced for acts they committed without knowledge of their actual illegality. In addition, the lack of uniformity in the interpretation and application of the invincible type error can generate confusion in Ecuadorian criminal justice.en_US
