dc.description.abstractEl presente trabajo de investigación se basará en determinar los aspectos que diferencian a la atenuante trascendental y a la cooperacio4n eficaz como dos figuras presentes en la legislación penal ecuatoriana, que, si bien son parte de un mismo género, eso no implica que sean iguales ya que cada una de ellas plantea un mecanismo distinto para incidir sobre los delitos tipificados en el Código Orgánico Integral Penal. Sus diferencias e incluso similitudes serán expuestos y analizados en el presente desarrollo con la finalidad de poder identificar el aporte que hace cada figura sobre el alcance de la justicia penal en el Ecuador. Abordaremos la procedencia de la cooperación eficaz y el atenuante trascendental no solo en base al Código Orgánico Integral Penal, si no también, conforme los aportes teóricos que hacen distintos autores en esta temática; de igual manera estableceremos los antecedentes que han permitido que ambas figuras se encuentren presentes en la legislación penal ecuatoriana.es
dc.description.abstractThis research work will be based on determining the aspects that differentiate the transcendental mitigation and effective cooperation as two figures present in Ecuadorian criminal law, which although they are part of the same genre, this does not imply that they are equal since each one of them proposes a different mechanism to influence the crimes defined in the Comprehensive Organic Criminal Code. Their differences and even similarities will be exposed and analyzed in the present development in order to be able to identify the contribution that each figure makes on the scope of criminal justice in Ecuador. We will address the origin of effective cooperation and the transcendental mitigation not only based on the Comprehensive Organic Criminal Code, but also, according to the theoretical contributions made by different authors on this subject; In the same way, we will establish the background that has allowed both figures to be present in Ecuadorian criminal law.en_US
