dc.descriptionAbstract: This essay deals with the issue of the Extinction of the Family Heritage, constituted in cases of Housing Cooperatives liquidated or extinguished. Therefore, we start with the following formulation of the problem: Who is competent to extinguish the family patrimony constituted in cases of liquidated or extinguished Housing Cooperatives and how is the procedure followed? For the development of this question, the general objective was to analyze the Extinction of the Family Heritage, constituted in cases of Housing Cooperatives liquidated or extinguished and as specific objectives: to characterize the family patrimony; describe the theoretical and legal aspects of the Housing Cooperatives liquidated or extinguished; determine who is competent to extinguish the family patrimony constituted in cases of Housing Cooperatives liquidated or extinguished and how is the procedure followed. The essay contains a structure formed by the introduction, the development of the objectives, the conclusions and the bibliography. It was concluded that the constitution of the family estate is a limitation of the domain, so it can not be mortgaged, seized or taxed, but the law determines exceptions, one when they are constituted in family patrimony when acquiring the house with financing granted by a cooperative of housing and, the debtor can not fulfill the obligation; another is for having declared a public interest. Currently, the Notarial Law in numeral ten of Art.18 provides that the extinction of family assets by legal mandate, will be made by notarial deed, with the institution that instituted it, authorize its extinction, if such institution does not exist, or is liquidated, the regulatory body will be in charge of authorizing the extinction.es_ES
dc.description.abstractEste ensayo trata el tema de la Extinción del Patrimonio Familiar, constituido en casos de Cooperativas de Vivienda liquidadas o extinguidas. Por lo tanto, se parte de la siguiente formulación del problema ¿Quién es competente para extinguir el patrimonio familiar constituido en casos de Cooperativas de Vivienda liquidadas o extinguidas y cómo es el procedimiento que se sigue? Para el desarrollo de esta interrogante se fijó como objetivo general analizar la Extinción del Patrimonio Familiar, constituido en casos de Cooperativas de Vivienda liquidadas o extinguidas y como objetivos específicos: caracterizar el patrimonio familiar; describir los aspectos teóricos y jurídicos de las Cooperativas de Vivienda liquidadas o extinguidas; determinar quién es competente para extinguir el patrimonio familiar constituido en casos de Cooperativas de Vivienda liquidadas o extinguidas y cómo es el procedimiento que se sigue. El ensayo contiene una estructura conformada por la introducción, el desarrollo de los objetivos, las conclusiones y la bibliografía. Se concluyó que la constitución del patrimonio familiar es una limitación del dominio, por lo que no se lo puede hipotecar, embargar ni gravar, pero la ley determina excepciones, una cuando se constituyen en patrimonio familiar al adquirir la vivienda con financiamiento otorgado por una cooperativa de vivienda y, el deudor no pueda cumplir con la obligación; otra es por haberse declarado de utilidad pública. Actualmente, la Ley Notarial en el numeral diez del Art.18 dispone que la extinción de patrimonio familiar por mandato legal, se hará mediante acta notarial, debiendo la institución que la instituyó, autorice su extinción, si dicha institución no existe, o se encuentra liquidada, el órgano regulador será el encargado autorizar la extinción.es_ES
