dc.description.abstractLa inteligencia artificial ha brindado transformaciones importantes en el sistema judicial, trayendo importantes propuestas para mejorar la eficacia en la administración de la justicia. En nuestro país, enfrentamos graves problemas que podrían ser resueltos por el uso de esta innovadora herramienta. De tal forma que, analizaré detalladamente como la Inteligencia Artificial podría dar un importante giro con respecto a la descongestión de casos. La adopción de inteligencia artificial en nuestro sistema judicial enfrentará desafíos muy importantes por superar. En esta tesis examinaré cuáles son las implicaciones éticas ilegales para que se haga un uso responsable de la misma. Se debe tomar en cuenta además que a nivel global en regiones, Europa y Norteamérica se ha avanzado de forma significativa en marcos legales específicos para la inteligencia artificial. En nuestro país la regulación es incipiente por lo que se encuentra en sus primeras etapas, por lo que se importante brindar una regulación íntegra y a la altura de esta tecnología con el objetivo de prevalecer los principios fundamentales y Derechos Humanos de los ciudadanos ecuatorianos. Por lo que, dentro de la tesis brindaré una propuesta de ley específica acerca de la aplicación de la inteligencia artificial en la justicia ecuatoriana que incorpore varios principios de procedimientos para que su implementación sea integral y contenga las menores fallas posibles. Además, este estudio tomará en cuenta los ejemplos de uso con respecto a otros países acerca de la inteligencia artificial en el ámbito judicial, destacando cómo se usa esta herramienta y como beneficiará su uso en los procesos judiciales.es
dc.description.abstractArtificial intelligence has brought us important transformations in the judicial system, bringing important proposals to improve the efficiency in the administration of justice. In our country, we face serious problems that could be solved by the use of this innovative tool. Therefore, I will analyze in detail how Artificial Intelligence could make an important turn regarding the decongestion of cases. The adoption of artificial intelligence in our judicial system will face very important challenges to overcome. In this thesis, I will examine what are the illegal ethical implications for a responsible use of it. We must also take into account that at a global level in regions, Europe and North America, significant progress has been made in specific legal frameworks for artificial intelligence. In our country, regulation is incipient so it is in its early stages, so it is important to provide comprehensive regulation at the level of this technology with the objective of prevailing the fundamental principles and human rights of Ecuadorian citizens. Therefore, within the thesis I will provide a specific legal proposal regarding the application of artificial intelligence in Ecuadorian justice that incorporates several procedural principles so that its implementation is comprehensive and contains as few flaws as possible. In addition, this study will take into account examples of use with respect to other countries regarding artificial intelligence in the judicial field, highlighting how this tool is used and how its use will benefit judicial processes.en_US
