dc.description.abstractEl presente trabajo de investigación estudia el tema “El delito de extorsión y asesinato a docentes cometido por adolescentes infractores en Ecuador”. Su objetivo general es analizar el delito de extorsión y asesinato a docentes cometido por adolescentes infractores en Ecuador, por medio de una investigación documental y una investigación de campo, para contribuir en la prevención de los delitos. A lo largo de la investigación se analiza diferentes cuerpos jurídicos como: Constitución del Ecuador, Código de la Niñez y Adolescencia, Código Orgánico Integral Penal, Ley Orgánica de Educación Intercultural y su Reglamento. La investigación llevada a cabo es documental lo cual permitió la elaboración del marco teórico en el que se da a conocer los antecedentes de investigación y para la fundamentación teórica se desarrolló los siguientes subtemas: definición de adolescente y adolescente infractor, antecedentes históricos del Código de la Niñez y Adolescencia, derecho a la seguridad en el entorno escolar, retroceso en materia de derechos de los docentes en Ecuador, el adolescente infractor en el sistema educativo, delito de extorsión, delito de asesinato y criterios psicológicos sobre la edad para responder penalmente. También se llevó a cabo una investigación de campo en el cual se utilizó como técnica de recolección de datos la entrevista realizada a cinco docentes de diferentes instituciones educativas y abogados/as con conocimiento en Derecho Educativo y adolescentes infractores y se dio a conocer los resultados obtenidos. El trabajo de investigación finaliza con las conclusiones, recomendaciones, bibliografía y anexos.es
dc.description.abstractThis research paper studies the topic “The crime of extortion and murder of teachers committed by adolescent offenders in Ecuador”. Its general objective is to analyze the crime of extortion and murder of teachers committed by adolescent offenders in Ecuador, through documentary research and field research, to contribute to the prevention of crimes. Throughout the research, different legal bodies are analyzed, such as: the Constitution of Ecuador, the Code of Children and Adolescents, the Comprehensive Organic Criminal Code, the Organic Law of Intercultural Education and its Regulations. The research carried out is documentary, which allowed the elaboration of the theoretical framework in which the research background is made known and for the theoretical foundation the following subtopics were developed: definition of adolescent and adolescent offender, historical background of the Code of Childhood and Adolescence, right to safety in the school environment, setback in terms of teachers' rights in Ecuador, the adolescent offender in the educational system, crime of extortion, crime of murder and psychological criteria on the age to respond criminally. A field investigation was also carried out in which the data collection technique was used the interview carried out with five teachers from different educational institutions and lawyers with knowledge in Educational Law and adolescent offenders and the results obtained were made known. The research work ends with the conclusions, recommendations, bibliography and annexes.en_US
