dc.descriptionAbstract: Social Security, conceived as an inalienable right of all people who live in the Ecuadorian territory, and who are affiliated with the Ecuadorian Social Security Institute (IESS), either personally or by employers, seeks to guarantee dignified access to the health, work risk, retirement and other services, it can never be violated, under any circumstances. Being fraudulent affiliation, considered by the Law, Jurisprudence and the Doctrine, as false or inappropriate, can today, end countless years of Social Security benefits, by the mere fact of being issued a report in the administrative headquarters by parts of IESS officials, who, in their opinion, consider that there was bad faith in the insurance of a certain person and in the payment of benefits. For this reason, this investigation work, proposes the reform of the Social Security Law, in particular the modification of article 80, relative to fraudulent affiliation, in order to establish the basic concepts of this type of affiliation and the procedure to be followed by the IESS, so that citizens know what it is, and not be affected by trying to defraud the State by inventing something inappropriate in terms of benefits, in turn, in case of error in the declaration of loss of benefits, the citizen can defend himself at the administrative headquarters, presenting various elements of discharge that help clarify the truth, saving time and resources without having to go to the courts to defend their rights.es_ES
dc.description.abstractLa Seguridad Social, concebida como un derecho inalienable de todas las personas que viven dentro del territorio ecuatoriano, y que están afiliados al Instituto Ecuatoriano de Seguridad Social (IESS), ya sea de manera personalmente o por los empleadores, busca garantizar el acceso digno a la salud, riesgos laborales, jubilaciones y otros servicios, nunca se puede violar, bajo ninguna circunstancia. Siendo la afiliación fraudulenta, considerada por la Ley, la Jurisprudencia y la Doctrina, como falsa o inapropiada, puede hoy, terminar incontables años de beneficios de la Seguridad Social, por el mero hecho de ser emitido un informe en la sede administrativa por parte de funcionarios del IESS, quienes, en su opinión, consideran que hubo mala fe en el seguro de determinada persona y en el pago de prestaciones. Por ello, este trabajo de investigación propone la reforma de la Ley de Seguridad Social, en particular la modificación del artículo 80, relativo a la afiliación fraudulenta, con el fin de establecer los conceptos básicos de este tipo de afiliación y el procedimiento a seguir por el IESS, para que los ciudadanos sepan en qué consiste, y no se vean afectados por intentar defraudar al Estado inventando algo inapropiado en materia de prestaciones, a su vez, en caso de error en la declaración de pérdida de beneficios, el ciudadano puede defenderse en la sede administrativa, presentando diversos elementos de descargo que ayuden a esclarecer la verdad, ahorrando tiempo y recursos sin tener que acudir a los tribunales para defender sus derechos.es_ES
