Resumen
El fundamento principal de la presente investigación es el estudio sobre los antecedentes, concepto, naturaleza del doble conforme, así como también el reconocimiento del doble conforme en los tratados internacionales. Elegir la posibilidad de aplicar el principio de doble conforme en los procesos penales y de la misma forma determinar la base jurídica de esta acción, cómo debe llevarse a cabo y por quién. El derecho a doble conforme es una garantía procesal estipulada en la Constitución y en varios instrumentos jurídicos internacionales, misma que tiene el procesado para que su fallo condenatorio pueda ser válida en dos instancias judiciales. Sin embargo, el recurso especial del doble conforme otorga la posibilidad de explorar íntegramente el fallo condenatorio emitido, concediendo mayor seguridad jurídica y respeto a los derechos de los condenados, a fin de que las citadas garantías procesales protejan al procesado, coartar el poder punitivo y evitar condena a personas inocentes. La principal motivación del presente ensayo es entender los antecedentes del doble conforme, el procedimiento para su aplicación, la competencia de quién resuelve sobre ello, el fundamento jurídico, y otros aspectos o temas relevantes de los derechos humanos y el derecho internacional.
Abstract
The main foundation of the present investigation is the study on the background, concept, nature of the double conformer, as well as the recognition of the double conformer in international treaties. Choose the possibility of applying the principle of double consent in criminal proceedings and in the same way determine the legal basis of this action, how it should be carried out and by whom. The right to double consent is a procedural guarantee stipulated in the Constitution and in several international legal instruments, which the defendant has so that his conviction can be valid in two judicial instances. However, the special recourse of double conforming grants the possibility of fully exploring the conviction issued, granting greater legal certainty and respect for the rights of the convicted, so that the aforementioned procedural guarantees protect the defendant, limit the punitive power and Avoid sentencing innocent people. The main motivation of this essay is to understand the background of the double agreement, the procedure for its application, the competence of who decides on it, the legal basis, and other relevant aspects or issues of human rights and international law.
