dc.description.abstractLa realización de este ensayo es importante debido a que el principio de motivación es fundamental para administrar justicia y así lo consagra el Art. 76 numeral 7, literal (l) de la Constitución de la República Ecuador, se debe tener claro que este principio debe ser utilizado de manera correcta en todas las resoluciones y sentencias judiciales, por tal razón, es importante analizar el nuevo estándar de la motivación y que el presente ensayo sirva de apoyo para los órganos encargados de impartir justicia, para que se respete el debido proceso y la tutela judicial efectiva, brindando un material de apoyo para las futuras generaciones de abogados, evitando así la incorrecta administración de justicia. En este sentido se analizará una sentencia que expide la Corte Constitucional de Justicia, la cual analiza todos los aspectos del principio de motivación, dejando claro cuál es el nuevo estándar de este principio.es
dc.description.abstractThe realization of this essay is essential because the principle of motivation is fundamental for the administration of justice and this is enshrined in Art. 76 numeral 7, literal (l) of the Constitution of the Republic of Ecuador, it must be clear that this principle must be used correctly in all resolutions and judicial sentences, for this reason, it is important to analyze the new standard of motivation and that this essay serves as support for the bodies responsible for imparting justice, so that due process and effective judicial protection is respected, providing a support material for future generations of lawyers, thus avoiding the incorrect administration of justice. In this sense, a sentence issued by the Constitutional Court of Justice will be analyzed, which analyzes all aspects of the principle of motivation, making clear what is the new standard of this principle.en_US
