dc.description.abstractEl presente ensayo de investigación aborda el tema correspondiente al testimonio anticipado en el delito de violación, se analizaron los aspectos conceptuales, jurídicos y teóricos en torno al objeto de investigación, a fin de comprender su utilidad de aplicación para las víctimas de este delito que transgrede el bien jurídico de la integridad sexual, tipificado en el Código Orgánico Integral penal, articulo 171. A través de un estudio teórico-descriptivo partiendo de técnicas documentales, se indagó sobre los aspectos teóricos, jurídicos y conceptuales en torno a la violación y al testimonio anticipado, tanto a nivel nacional como internacional, así como su vinculación con el derecho de las víctimas a la no revictimización. Como principales conclusiones, del estudio se derivó la importancia que tiene el testimonio anticipado de la víctima, convirtiéndose en una prueba preponderante para sancionar el delito de violación y, que por la gravedad y daños que causan los delitos contra la integridad sexual, como es la violación, se da la evacuación del testimonio de la víctima con antelación a la etapa de juicio, sin embargo es ingresada, como medio de prueba, con igual validez procesal de aquellos testimonios evacuados dentro de ésta etapa. La presente investigación y planteamiento del tema toman vital relevancia cuando se tiene en cuenta que Ecuador es un país con un índice de violencia a la integridad sexual en incremento exponencial, sobre todo en los últimos años.es
dc.description.abstractThis research essay addresses the subject corresponding to the anticipated testimony in the crime of rape, the conceptual, legal and theoretical aspects around the anticipated testimony and the crime of rape in Ecuador were analyzed, in order to understand its usefulness of application for the victims of this crime, typified in the Comprehensive Organic Penal Code, article 171. Through a theoretical-descriptive study based on documentary techniques, the theoretical, legal and conceptual aspects of rape and anticipated testimony were investigated, both nationally and internationally, as well as its connection with the right of victims to non-revictimization. As main conclusions, the study derived the importance of the anticipated testimony of the victim, becoming a preponderant test to punish the crime of rape and that due to the seriousness and damage caused by crimes against sexual integrity, such as rape. , the victim's testimony is evacuated prior to the trial stage, however it is entered, as a means of evidence, with the same procedural validity as those testimonies evacuated within this stage. The present investigation and approach to the subject take on vital relevance when it is taken into account that Ecuador is a country with an exponentially increasing rate of violence against sexual integrity, especially in recent years.en_US
