dc.descriptionAbstract: The purpose of this paper is to analyze the constitutional rights to live in a healthy environment and to nature as a subject of rights such as the current vision of environmental law. The exigibility of the restoration that they have from the beginning of the supreme norm for the environmental principles of indubio pro nature and restoration and the possibility that exists in the normative to realize through the restorative justice. For what will be analyzed the supreme norm, the international treaties, the anthropocentric and biocentric vision of the current environmental law, the indigenous justice and restorative justice as alternative methods for the realization of the constitutional guarantee in environmental matters.es_ES
dc.description.abstractEl objeto de este trabajo es analizar los derechos constitucionales a vivir en un ambiente sano, y a la naturaleza como sujeto de derechos como la visión actual del derecho ambiental. La exigibilidad de restauración que tienen desde el garantismo de la norma suprema por los principios ambientales de indubio pro natura y restauración y la posibilidad que existe en la normativa de realizarlos a través de la justicia restaurativa. Para lo cual se analizará la norma suprema, los tratados internacionales, la visión antropocéntrica y biocéntrica del derecho ambiental actual, la justicia indígena y la justicia restaurativa como métodos alternativos para la realización del garantismo constitucional en materia ambiental.es_ES
