Resumen
El presente trabajo, pretende configurar una herramienta valiosa respecto a la contradicción; basado en la descripción de conceptos, principios y doctrina aplicable a efectos de desvirtuar la idoneidad de la diligencia, personal y de testimonio.
Se hará una referencia histórica, diferenciando el sistema inquisitivo unipersonal, del contradictorio,en donde el Estado de derechos y justicia adecua su legislación, priorizando al ser humano sobre la ley; en base a principios de uso permanente del ciudadano.
Se esquematizará la contradicción en la práctica del medio probatorio testimonial, conforme lo siguiente: se establecerá presupuestos y formalidades del testimonio; La características de pertinencia, utilidad, conducencia; como presupuestos propios; la elaboración del testimonio, el procedimiento y la contradicción como tal, y el tipo de preguntas que se pueden objetar; esto es, las capciosas, sugestivas, compuestas, vagas, confusas, impertinentes o hipotéticas (conclusivas);se hablará de las consecuencias de un mal testimonio, mismo que puede derivar en una declaratoria de testigo hostil y/o perjuro.
