dc.descriptionAbstract: The present work, intends to configure a valuable tool regarding the contradiction; based on the description of concepts, principles and applicable doctrine in order to detract the suitability of the diligence, personal and testimony, it will stablish a historical reference, differentiating the unipersonal inquisitive system from the contradictory where the State of rights and justice is adequating your legislation, prioritizing the human being over the law; based on the permanent use of axioms for the citizen The contradiction in the practice of testimonial evidence will be outlined as follows: the budgets will be established and formalities of testimony; The characteristics of belonging, utility, conductivity; as own budgets, the elaboration of the testimony, the procedure and the contradiction as such, and the type of questions that can be objected; that is, the sham, suggestive, compound, vague, confused, impertinent or hypothetical (conclusive); The consequences of bad testimonies will are discussed, which lead to a hostile witness statement and / or perjury.es_ES
dc.description.abstractEl presente trabajo, pretende configurar una herramienta valiosa respecto a la contradicción; basado en la descripción de conceptos, principios y doctrina aplicable a efectos de desvirtuar la idoneidad de la diligencia, personal y de testimonio. Se hará una referencia histórica, diferenciando el sistema inquisitivo unipersonal, del contradictorio,en donde el Estado de derechos y justicia adecua su legislación, priorizando al ser humano sobre la ley; en base a principios de uso permanente del ciudadano. Se esquematizará la contradicción en la práctica del medio probatorio testimonial, conforme lo siguiente: se establecerá presupuestos y formalidades del testimonio; La características de pertinencia, utilidad, conducencia; como presupuestos propios; la elaboración del testimonio, el procedimiento y la contradicción como tal, y el tipo de preguntas que se pueden objetar; esto es, las capciosas, sugestivas, compuestas, vagas, confusas, impertinentes o hipotéticas (conclusivas);se hablará de las consecuencias de un mal testimonio, mismo que puede derivar en una declaratoria de testigo hostil y/o perjuro.es_ES
